According to the Kauai MLS there were 50 closed sales for the month of October 2009. 10 of these or 20% were REO properties. My guestimate is that these figures will probably remain the same to the end of the year. According to one REO bank insider banks may be holding off on foreclosures and evictions around the holidays but then will be stepping it up again in January. Kauai foreclosures & REO inventory  should continue until at least another 6 to 12 months. I would think by this time next year the REO inventory will be slowing down. New Upcoming Kauai REO Property:

 #1. 4277 Puaole Street, Lihue. I haven’t driven by this home yet. But according to the Kauai Business Report  not only was there a foreclosure action but also a court foreclosure ejectment filed. When a home is foreclosed on by the bank and they take it back in foreclosure and the home is found occupied the banks usually try to work out a agreement with the occupant to move. However if the occupant refuses to move the Bank’s attorney goes back to court to get a writ of ejectment which allows the sherrif to physically remove the occupant. According to the Kauai Business Report the Plaintiff appears to be a private company or firm rather than a traditional bank. Not all notices of foreclosure will lead to be a listed REO property. But when a notice of ejectment is filed along with a foreclosure it is a sure sign that the property is banked owned (or private party foreclosure).

 The Kauai Business Report is an interesting resource in seeing what foreclosure have been filed in court, It also lists recorded real estate transactions. But because the publication only comes out monthly it can be outdated. On the October 14th 2009 issue on page 15 of closed transactions it lists closed sales for the month of August. So while it lists the foreclosure/bank recordation of my listed Makauena unit, that property had already closed on the 9th of October on a resale. However other bank owned properties are listed. Page 15 has the foreclosure actions. But please note not all foreclosures become REOs. Many are postponed due to loan mods, bankruptcy proceedings and other legal proceedings. Wow, one half of the 44 Listed REOs are in escrow. Closings should be increasing for the months of October thru December. Upcoming (not yet listed) Kauai REOs will be featured in next weeks blog. One of the most interesting solds last  month was the Princeville at Mauna Kai #5A condo. I originally had this condo listed but then lost the listing to another Realtor. We both had a hard time selling it due to high HOA fees ($877 a month) and the age of the spacious unit. The price dropped to $219,000 before it went to auction. At auction I can only guess that “bargain” hunters got caught up in the thrill of the bidding. The unit sold for $275,000 without the protections of the standard  Realtors contracts.  I agree that now is the time to buy but you sill need the benefit of a local Realtor’s guidance and knowledge to get the best possible “deal”.
