Act 48 placed a temporary moratorium on Part I non-judicial foreclosures which prior to the Act was the most common foreclosure method in the state of Hawaii. The general assumption was when Act 48 expired in July of this year  the banks who were wating for the expiration would start foreclosing again. But because House Bill 1875, which passed this month, totally repealled Part I of the non judicial process the dramatic increase of foreclosures and REO inventory after July will not happen. Instead what is happening is the slower steady increase of judicial foreclosures. Not only is this a much slower costlier process but it also has its major disadvantages for the mortgagee/former owner. The advantage to the judicial foreclosure process is that the mortgagee/home owner will automatically have their day in court prior to eviction proceedings. 

I didn’t have any property photos for this blog so I sneaked in a picture of  my daughter Kela an me walking/posing with our dogs on the Kealia path. This is one of the advantages of living on Kauai.

    According to the Kauai MLS 71 properties sold last month April 2012 but only 8 were REOs or banked owned. 11 of those sold listings were tagged as Short Sale properties. That totals at 11.25% as REO sales and 15.5% as short sales.
     
    The real news this week is that Act 48 has been modified to House Bill 1875. I have listed  some other blog addresses for information. Most the changes appear to be good but I don’t know how the banks  and their attorneys will react to it. Here are the links:

      Property Tax foreclosures are not that common on Kauai. However The Garden Island Newspaper has recently ran a list of 6 properties that are up for auction by the County of Kauai. I can’t seem to find the list on line yet on either site but it’s sure to run again. The sale is on May 17, 2012 at 9:00am. It appears all six properties are vacant land. The main issue with property tax foreclosures is that there is a one year right of redemption. So the purchaser has their money tied up for a year because the former owner has the right to pay their taxes and get the property back. Of course the  purchasers money is refunded.               59 sales according to the Kauai MLS for the month of March 2012. 6 closed REO sales equates to a 10% ratio of REO sales to total sales. REO inventory is dwindling due to Hawaii’s Act 48 foreclosure moratorium. There has been no news yet as to whether law makers will do anything after it expires in July. Hopefully that won’t extend it  as the legislation they arbitrarily passed backfired. Don’t get me wrong there is definitely a need for  lender and foreclosure reform but Act 48 was poorly written and executed. Hopefully the legislature will realize they don’t know it all and get professional advise when it comes to foreclosure reform.

                  Not much of an update this week. I haven’t been seeing a significant increase in Judicial Foreclosures yet. I really think most lenders are just holding out until the non judicial foreclosure moratorium is lifted in July of this year. Local lenders appear to favor judicial foreclosures where they can come after the mortgagor for a deficiency judgment. National lenders appear to favor non judicial foreclosures which are faster and cheaper but there can be no deficiency judgement.

                    Wow what a lot of rain and even hail the past week. I hope you stayed dry. Inventory appears to be getting tighter. I wasn’t expecting this to happen so early in the year. I’m expecting multiple offers in on some of my new REO listings. Per Wells Fargo policy on Papalina, Kalaheo house no offers are allowed to be submitted for the first 7 days then only offers from owner occupant days 8-14. It’s a good policy encouraging home ownership.
